Copyright Policy

In today's modern internet age it is impossible for any one person or organization to know every single design that enjoys protection under IP law. Therefore, we comply with the Digital Millennium Copyright Act ("DMCA"). The DMCA provide a method for owners of protected IP to submit an infringement claim to a service provider such as Pulp & Stitch. Once a claim is submitted, the DMCA requires that we respond in certain ways and within certain time-frames. We have adopted the following general policy toward copyright and intellectual property infringement in accordance with U.S. intellectual property laws, including the Digital Millennium Copyright Act of 1998. Please contact Pulp & Stitch’s Legal Department via e-mail at legal@pulpandstitch.com (preferred method of contact) for any and all Notice and Counter Notice of claims of copyright or other intellectual property infringement.

Pulp & Stitch respects artists and the intellectual property of others. We take reports of copyright infringement very seriously. Although our team has created many original pieces exclusively for pulpandstitch.com (the “Site”), they have also curated much of our catalogue from other sources. They have made every good faith effort to choose only those items strictly in the public domain.

In accordance with the Digital Millennium Copyright Act of 1998, the text of which may be found on the U.S. Copyright Office website here, Pulp & Stitch removes material that is the subject of a compliant DMCA takedown notice. Any removal of material by Pulp & Stitch in accordance with compliant DMCA procedure does not automatically constitute an admission of guilt or culpability. We do this in accordance with the Online Copyright Infringement Liability Limitation Act of the Digital Millennium Copyright Act (17 U.S.C. § 512) ("DMCA"), section 512 of the DMCA, which provides the rules for reporting copyright infringement and for filing a counter-notification.

If you believe your copyright is being infringed, you can report the alleged violation. In response, a counter-notification may also be filed.

If you're not sure whether material on pulpandstitch.com infringes on your copyright, please consult with an attorney before filing a DMCA notification. Misrepresenting that material infringes on your copyright may subject you to liability for damages, including costs and attorneys' fees incurred.

If you believe that your content has been used in a way that constitutes an infringement of your rights, or your intellectual property rights have been otherwise violated, please notify Pulp & Stitch's designated agent for complaints (contact email below) by sending a Notice and Takedown Report. Provide the following information in writing pursuant to the DMCA (Please review these requirements with your legal counsel and see Section 512(c)(3) of the Copyright Act) (the "Notice"). Please note that all information must be submitted in English:

1. identification and description of the copyrighted work you believe to have been infringed or, if the claim involves multiple works on the Website, a representative list of such works;

2. a complete URL of the material that you claim is infringing, in a sufficiently precise manner to allow for Pulp & Stitch to locate the material; identification of the material you believe to be infringing in a sufficiently precise manner to allow us to locate that material (and note that providing URLs in the body of an email is the best way to help us locate content quickly);

3. a statement by you that you understand that under 17 U.S.C § 512(f) you may be liable for any damages, including costs and attorneys' fees, if you knowingly and materially misrepresent that reported material or activity is infringing;

4. adequate information by which we can contact you (including your name, postal address, telephone number and e-mail address);

5. a statement that you have a good faith belief that use of the copyrighted material is not authorized by the copyright owner, its agent or the law;

6. a statement that the information in the written notice is accurate; and

7. a statement, under penalty of perjury, that you are the copyright owner or authorized to act on the copyright owner's behalf.

If you fail to comply with all of the requirements of Section 512(c)(3) of the DMCA, your DMCA Notice may not be effective. Please be aware that if you knowingly materially misrepresent that material or activity on the Website is infringing your copyright, you may be held liable for damages (including costs and attorneys' fees) under Section 512(f) of the DMCA.

Once a proper bona fide infringement notification or violation report is received by Pulp & Stitch’s Legal Department (the designated agent for DMCA purposes), Pulp & Stitch will review your submission and take whatever action, in its sole discretion, it deems appropriate. This may include removal of the infringing content or filing a counter-notification.
